Terms of Service

These terms govern your use of Spurkle ("the service"): the macOS app, Chrome extension, website, and any other Spurkle clients. Spurkle is operated by Dallin Romney as a personal project. By using Spurkle you agree to these terms. If you don't agree, please don't use the service.

1. Eligibility

You must be at least 13 years old to use Spurkle. By using it, you confirm you meet this requirement.

2. Your account

You sign in with Google or Apple and choose a public handle. You're responsible for activity under your account. Keep your sign-in secure; tell us promptly if you suspect unauthorized access.

3. What Spurkle is

Spurkle lets you and friends who have also installed Spurkle send each other bursts of emoji confetti. Friendships are mutual; both people must accept. You can remove, mute, or block other users at any time.

4. Acceptable use

You agree not to:

• harass, threaten, spam, or abuse other users, or send unwanted content after someone has muted, blocked, or removed you;
• upload or send content that is illegal, hateful, sexually explicit, or that infringes someone else's rights (including via custom emoji or images);
• attempt to scrape, enumerate, or harvest users or data, or circumvent rate limits, blocks, or other protections;
• probe, overload, reverse-engineer, or disrupt the service or its infrastructure, or access it through unauthorized automated means.

5. Your content

You keep ownership of content you upload (such as custom emoji). You grant Spurkle the limited rights needed to store it and deliver it to the recipients you send it to. You're responsible for the content you send and confirm you have the right to send it.

6. Premium

Spurkle offers an optional paid Premium subscription. Pricing and what Premium unlocks are shown at purchase. Billing is handled by the relevant provider (Apple for App Store purchases, Stripe for direct purchases); manage or cancel your subscription through that provider. Charges are non-refundable except where required by law or the provider's policies.

7. Suspension & termination

You can delete your account at any time from the app, which removes your data as described in the Privacy Policy. We may suspend or terminate accounts that violate these terms (including blocking an account from sending) to protect users and the service.

8. Disclaimers

Spurkle is provided "as is," without warranties of any kind. We don't guarantee that the service will be uninterrupted, error-free, or that messages will always be delivered.

9. Limitation of liability

To the maximum extent permitted by law, Spurkle and its operator won't be liable for any indirect, incidental, or consequential damages arising from your use of the service.

10. Changes

We may update these terms. If we make material changes, the "Last updated" date above will change. Continued use after a change means you accept the updated terms.
